Quebec does not use a single universal percentage that automatically applies to every lease. The Tribunal administratif du logement publishes calculation parameters, and the justified increase can depend on changes in taxes, insurance, maintenance, major repairs and other permitted expenses.
There is no simple province-wide maximum percentage for all residential leases. If the parties cannot agree, the Tribunal administratif du logement can determine the rent using the applicable legal calculation method.
A proper estimate considers the TAL calculation parameters together with eligible changes in the building’s expenses and work. The calculator should therefore use the relevant year and property-specific amounts rather than applying a flat percentage to the current rent.
A tenant may refuse a proposed increase while choosing to renew the lease, subject to the notice and response rules. The landlord can then apply to the Tribunal administratif du logement within the applicable time limit to have the rent fixed.
Major repairs and improvements can affect the rent calculation when they qualify under the TAL methodology. The effect is based on eligible expenditures and the applicable calculation parameters rather than simply passing the full renovation cost into one year of rent.
